JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 20-09-2022 Petitioner in the present case is seeking a direction to the respondent authorities to conduct proper investigation and to ensure arrest of the accused persons and recover the kidnapped daughter of the informant-petitioner in connection with Pirbahore P.S. Case No. 391 of 2019 dated 20.07.2019 registered for the offences under Sections 366A/34 of the Indian Penal Code. In this case, a counter affidavit has been filed on behalf of the State. It is stated therein that the victim girl has been recovered and her statement has been recorded under Section 164 Cr.P.C. It is stated that in course of her statement, she has stated that she had gone

Patna High Court CR. WJC No.74 of 2020(3) dt.20-09-2022 2/2 with Sagar Singh to Bhubneshwar by train and has solemnized marriage with him in a temple on her own volition. The counter affidavit shows that the case has been duly investigated, recovery of victim has been made and in course of investigation, the FIR named accused Md. Adil Raja was arrested and forwarded to jail. The statement made in the counter affidavit has not been controverted by the petitioner.

In the given facts and circumstances of the case, this Court finds that this writ application has become infructuous and is being disposed of accordingly.
