JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-10-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner, namely, Santosh Kumar is said to have made attempt to commit rape on the informant along with other FIR named accused persons but submission on behalf of the petitioner is that a quarrel had taken place between the parties for which grand father of petitioner lodged Narhat P.S. Case No. 63 of 2014 against the prosecution party for the occurrence of 18.04.2014 just after the occurrence but the present case was lodged on 19.04.2014 for the occurrence of 18.04.2014 in retaliation to the above stated Narhat P.S. Case No. 63 of 2014. Moreover, co-accused, Niranjan Kumar and some others have already been granted privilege of bail by a Bench of this court.

Patna High Court Cr.Misc. No.33791 of 2015 (3) dt.30-10-2015 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Nawada in connection with Narhat P.S. Case No. 64 of 2014.
