JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-07-2019 This is an application for grant of anticipatory bail in connection with Gorul P.S. Case No. 303 of 2017, disclosing offences under Sections 302, 120B, 34 of IPC and Section 27 of the Arms Act.

Prosecution story is that son of the informant was working in Hajipur Showroom of Hyundai Company and he use to go by motorcycle and on 29.11.2017 at about 8:00 P.M. he received an information that someone has shot fire arm injury his son and was sent at P.H.C. Goraul for medical treatment. Thereafter, the informant went there and found his son dead and thereafter, the informant named Ranjeet Dass, Ram Pravesh Dass, Amir Dass and Madhubaali Devi against whom he attributed allegation of murder of his son on the basis of suspicion as there was land dispute between the parties and there was a scuffle five days ago between them and they have

Submission of the learned counsel for the petitioner is that except the suspicion nothing against the petitioner and the other accused persons having similar allegation on the basis of suspicion, have been granted bail vide order dated 26.04.2018 in Criminal Misc. No.17195 of 2018 by a co-ordinate Bench of this Court.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M. Vaishali at Hajipur, in connection with Gorul P.S. Case No. 303 of 2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with further condition that he is to co-operate with the investigation and appear before the police as and when required.
