JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-03-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Simultalla P.S. Case No. 34/2019 registered for the offences punishable under Sections 323, 341, 324, 307, 504/34 of the Indian Penal Code.
Petitioner happens to be own nephew of the informant and it is alleged that he gave single iron rod blow causing head injury to informant but learned counsel appearing for petitioner submits that altogether four injuries were found on the person of the informant. He, further, submits that almost all the injuries are simple in nature and injuries, which were found on the head of the informant, are said to have been caused by
Patna High Court CR. MISC. No.4919 of 2020(2) dt.02-03-2020 2/2 sharp cutting weapon. He, further, submits that petitioner does not have any criminal antecedents and the informant goes to show that the alleged occurrence took place on account of petty dispute and as a matter fact, no case under Section 307 of the Indian Penal Code is made out.
Considering the aforesaid facts and circumstances as well as submissions of the parties, it is ordered that above named petitioner, in the event of his arrest/ surrender within six weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in Simultalla P.S. Case No. 34/2019 subject to conditions as laid down under Section 438(2) of the Cr.P.C. (Hemant Kumar Srivastava, J) Spd/- U T
