The petitioner is languishing in custody in connection with Bhargama P.S. Case No. 169 of 2015 for the offence instituted under Section 302/34 of the Indian Penal Code. There is allegation against the petitioner that he along with other co-accused persons committed murder of the deceased due to previous land dispute.
It has been submitted on behalf of the petitioner that petitioner is in custody since 02.03.2016. Charge sheet has been submitted in the present case and there is no criminal antecedent against the petitioner. There is no allegation of tampering of the witnesses against the petitioner. Patna High Court Cr.Misc. No.23722 of 2016 (4) dt.05-08-2016 2/2 allegation against the petitioner. No specific injury has been attributed against the petitioner.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Bhargama P.S. Case No. 169 of 2015.
