The petitioner is languishing in custody since 29.10.2018 in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. From a Magic vehicle, 162 litres of illicit foreign liquor was recovered. It is alleged that the petitioner was found travelling in the alleged vehicle.

It is submitted by learned counsel for the petitioner that the petitioner was not aware about the illicit liquor being kept in the alleged vehicle. A statement has been made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent.

Patna High Court Cr.Misc. No.6667 of 2019(2) dt.06-02-2019 2/2 Learned APP submits that the petitioner was found travelling in the vehicle, wherein illicit liquor was kept. Considering the fact that the investigation has already been concluded and period under custody, coupled with the statement made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Additional Sessions Judge-II, Banka in connection with Excise Complaint Case No. 143 of 2018.
