JUSTICE SUDHIR SINGH ORAL ORDER 05-08-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 341, 323,307,504,506/34 of the Indian Penal Code and 27 of Arms Act.

It is alleged that the present petitioner gave order to shoot the informant, as a result of which the two persons took out pistols from their waist and started firing with an intention to kill. One of the pellet hit the chest of the informant, second pellet hit the right side of the stomach, third pellet hit in the finger of right hand and fourth pellet passes through head by making abrasion. It is submitted on behalf of the petitioner that the petitioner is in custody since 21.02.2016.The petitioner has got no criminal antecedent. Charge sheet has already been submitted in

Patna High Court Cr.Misc. No.23456 of 2016 (4) dt.05-08-2016 2/2 this case. There is no allegation of tampering of the witnesses against the petitioner. The petitioner is said to be an order giver. No injury has been attributed against the petitioner. On behalf of the State, it is submitted that the petitioner is named in the FIR.

In the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Sheikhpura in connection with Sheikhpura (Kushumbha O.P.) P.S.Case No. 56 of 2016.
