JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-01-2019 This is an application for grant of anticipatory bail in connection with Dhamdaha P.S. Case No. 163 of 2018, disclosing offences under Sections 147, 148, 149, 341, 323, 307, 379, 504, 506, 34 of the Indian Penal Code.
Allegation against the petitioners is that during Iftar party, they came to the house of the informant, abusing him and also assaulted him and others and allegation against petitioner no.3 is of snatching Rs.10,000/.
Submission of learned counsel for the petitioners is that there is case and counter case between the parties and all injuries are simple in nature and they have no criminal antecedents.
Patna High Court Cr.Misc. No.4908 of 2019(2) dt.29-01-2019 2/2 Heard learned A.P.P. as well as learned counsel for the informant.
Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea, in connection with Dhamdaha P.S. Case No. 163 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
