The petitioner seeks bail in Chausa P.S. Case No. 193 of 2018, instituted for the offences under Sections 25(1-B)a, 26,35 of the Arms Act.
It is alleged in the written report that one country made musket and one country made loaded pistol was recovered from possession of petitioner.
Learned counsel for the petitioner has submitted that petitioner is in custody since 26.07.2018.
Learned APP for the State has submitted that petitioner has criminal antecedent. He has 13 cases pending against him.
Learned counsel for the petitioner has submitted that
Patna High Court Cr.Misc. No.7845 of 2019(2) dt.11-02-2019 2/2 in all 13 cases petitioner is either on bail or on acquittal. He further submits that one of the co-accused has already been granted bail by coordinate Bench of this court vide order dated 24.01.2019 passed in Cr. Misc. No. 75630 of 2018. Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Udakisunganj, Madhepura, in connection with Chausa P.S. Case No. 193 of 2018. Both the bailors will be close relative of petitioner. Petitioner will remain present. (Sanjay Priya, J) khushbu/- U T
