The petitioner seeks regular bail in connection with Sheohar P.S. Case No. 115 of 2014 for the offence registered under Section 387 of the Indian Penal Code.
The informant alleged that the telephone call was made on the mobile of his sister from Mobile No. 8470961333 and the caller demanded extortion.
Learned counsel for the petitioner submits that petitioner is not named in the First Information Report. The name of the petitioner has figured in the confessional statement
Patna High Court Cr.Misc. No.34703 of 2014 (3) dt.16-01-2015 2/2 of co-accused Gautam Chaudhary and the police, during the course of investigation, did not find any tangible evidence to show the involvement of the petitioner.
It appears that except the confessional statement of co-accused, nothing has been collected against the petitioner. The petitioner is in custody since 29.06.2014. Considering the facts aforesaid, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sheohar in connection with Sheohar P.S.
