Petitioner is not named in the first information report nor anything has been recovered from his conscious possession and it appears that the name of petitioner came in the confessional statement of co-accused. Moreover, having more or less similar allegation co-accused Md. Muntazir Alam @ Mantazir Alam has already been granted privilege of bail.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Katihar in connection with Azam Nagar P.S.Case No. 75 of 2015.
