JUSTICE SUDHIR SINGH ORAL ORDER 08-08-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 392 of the Indian Penal Code.

Prosecution case, in brief, is that four persons in two motorcycles came at Rani Fuel Station and at the point of pistol looted Rs. 25,000/- and two mobile phones from the informant. Petitioner has been made accused in the present case on the basis of confessional statement of the co-accused.

It has been submitted on behalf of the petitioner that he is in custody since 7.1.2015. Chargesheet has been submitted against the petitioner. No allegation of tampering of evidence is alleged against the petitioner. Petitioner is not named in the F.I.R. His name has come on the basis of confessional statement of the co-accused. Petitioner has not been put on T.I.P. to ascertain his involvement in the present case. There is no recovery of any incriminating article from the conscious possession of the petitioner.

On behalf of the State, it is submitted that name of the petitioner has come in course of investigation.

No.24989 of 2016 (4) dt.08-08-2016 2/2 Considering the aforesaid facts and circumstances, , let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada, in connection with Kashichak (Shahpur O.P.) P.S. Case no. 2 of 2015.
