The petitioner seeks bail in anticipation of his arrest in connection with Malsalami P. S. Case No. 409 of 2019, dated 30.10.2019, instituted for the offences under Sections 365, 506 and 34 of the Indian Penal Code.

The wife of the kidnapped person suspects the hand of the petitioner in this kidnapping. The victim has not yet been returned.

The petitioner had been threatening the victim

Patna High Court CR. MISC. No.7512 of 2020(3) dt.20-09-2021 2/2 of serious consequences because of dispute over money. Considering the fact that the victim has not yet been recovered, I am not inclined to grant anticipatory bail to the petitioner.

The prayer for anticipatory bail is rejected. However, if the petitioner surrenders before the court below and seeks bail, that shall be considered on its own merits, without being prejudiced by the fact that the present petition on his behalf has not been entertained by this Court.
