JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-08-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. There is accusation against the petitioners that they assaulted the informant and others by means of lethal weapons but submission on behalf of the petitioners is that there is case and counter case between the parties and persons from both the sides sustained injuries.

It is also pointed out on behalf of the petitioners that petitioners no. 2 to 4 were granted privilege of anticipatory bail by this court vide order dated 29.05.2013 passed in Cr. Misc. No. 14258 of 2013 but unfortunately, the aforesaid order could not be

No.34412 of 2015 (2) dt.28-08-2015 2/2 communicated to the petitioners as a result whereof, petitioners no. 2 to 4 failed to surrender before the court below within the period as prescribed by this court. Moreover, petitioners themselves surrendered before the court below on 25.06.2015 and since then they are languishing in jail custody. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Bathnaha P.S. Case No. 23 of 2010.
