The petitioner seeks bail in a case registered under Sections 302, 201 of the Indian Penal Code.

Allegation against the petitioner is of killing the son of the informant by pressing his neck and threw his dead body. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 24-05-2018. Charge sheet has already been submitted. The petitioner has falsely been implicated in the present case. There is no other substantive evidence to suggest the implication of the petitioner in the present case.

Patna High Court CR. MISC. No.7188 of 2019(3) dt.23-04-2019 2/2 On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R. The witnesses in paragraphs-37, 38 and 39 of the case diary have alleged that they have seen the petitioner disposing of dead body of the deceased. The postmortem report corroborates the allegation, made in the FIR. .

Considering the nature of allegation, I am not inclined to grant bail to the petitioner. Accordingly, prayer for bail of the petitioner in connection with Sessions Trial No. 177 of 2018 arising out of Shankarpur P.S. Case No. 61 of 2018 is rejected. (Sudhir Singh, J) A.K.V.//- U T
