JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 05-11-2015 Heard the learned counsel for the petitioner as well as the learned A.P.P.

The petitioner seeks bail in a case for the offences punishable under sections 302, 201 and 120 (B)/34 of the I.P.C Meena Devi one of the daughter of the informant was married with the petitioner and on 09.05.2014, the informant was informed telephonically that Meena Devi has died, then the informant and others went there and saw Samdhi Bharat Yadav in funeral dress and there the other daughter Kunti Devi was senseless and after regaining sense narrated the entire story. Submission is of false implication and that the deceased died due to pain in her stomach and after her death the informant was informed. There was no motive to commit murder.

No.32241 of 2015 (3) dt.05-11-2015 2/2 There is no specific allegation against the petitioner and as such he deserves sympathetic consideration, to which the learned A.P.P. opposes by submitting that Kunti Devi has supported the allegation against the petitioner who being husband is solely responsible and further prayer for bail of Bharat Singh has already been rejected by another coordinate Bench of this Court. In the facts and circumstances as stated above, considering that the petitioner is the husband and the version of the informant has been supported by Kunti Devi also vide paragraph-7 of the case diary and as such at this stage this Court is not inclined to enlarge the petitioner on bail and accordingly his such prayer stands rejected in connection with Sessions Trial No. 363 of 2014 arising out of Buxar ( M) P.S. Case No. 111 of 2014 pending in the court of A.D.J. 6th, Buxar.
