It is submitted by the petitioner's counsel that from Annexure-6 of the rejoinder, which is a list of family of the

Patna High Court CWJC No.5434 of 2021(11) dt.14-12-2022 2/2 deceased (petitioner's father), it is apparent that his name finds mention therein. The fact that he is an off-spring of the second wife, therefore, cannot come in the way of the petitioner for receiving the benefits on account of demise of his father. For the said claim, he would be approaching the newly added respondent.

In view of the said submission, Mr. Singh, learned senior counsel for the respondent have submitted that whatever claim the petitioner may raise, relief would be limited to the benefits available under the extant circulars/rules in the Respondent-Company.

In view thereof, the writ petition is disposed of without expressing any opinion on the merits of the submission advanced by the rival parties to enable the petitioner to approach the newly added respondent.
