JUSTICE SANJAY PRIYA ORAL ORDER 2/ 23-01-2019 Heard learned counsel for the petitioner and learned APP for the State as well as counsel for the informant. Petitioner seeks bail in Kotwali P.S. Case No.633 of 2018 instituted for the offence under Section(s) 342, 386, 506/34 Indian Penal Code.

In the written report, it is alleged that while the informant had gone to file tender in the office of Patliputra Bhawan Pramandal, on 18.09.2018, one person told him to pay rupees two lac as ransom to Bindu Singh for getting the contract. The informant raised objection then the petitioner along with other accused, as named in the First Information Report, put pistol on the face of the informant and snatched his golden chain, bracelet etc.

Patna High Court Cr.Misc. No.2889 of 2019(2) dt.23-01-2019 2/2 Counsel for the petitioner submits that petitioner is registered Contractor of Road Construction Department. The informant with a view to deprive him to participate in tender has implicated him in this false and fabricated case. Petitioner is in custody since 24.09.2018.

Counsel for the informant has appeared and opposed the prayer for bail.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st class, Patna, in connection with Kotwali P.S. Case No.633 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
