The petitioners apprehend their arrest in connection with Kishanpur P.S. Case No.127 of 2021 registered for offences under Sections 302 and 201/34 of the Indian Penal Code.

The dead body of the deceased was recovered from house of the petitioner. It has come during investigation that Jubeda Khatoon was only there in the house and nobody was there in the house.

From the materials available on record it appears that Jubeda Khatoon was present inside the house along with the

Patna High Court CR. MISC. No.6361 of 2022(3) dt.26-04-2022 2/2 deceased. If the deceased had died unnatural death, it is for Jubeda Khatoon to explain the same. There is no evidence that these petitioners were present and then the deceased had died. It has been submitted by learned counsel for the petitioners that the deceased died of Corona and he was cremated inside the house and in fact, at the time of Covid-19, nobody was supporting anyone for cremation of a person who died of Corona.

Considering the aforesaid facts, this application for anticipatory bail is allowed.

Accordingly, let petitioners, above-named, in the event of their arrest or surrender within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Kishanpur P.S. Case No.127 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
