It has been alleged by the informant Ramcharitra Singh, father of deceased Pankaj Singh that while Pankaj Singh had gone to the shop of Hare Ram Singh to purchase wine, an altercation took place. Pankaj Singh returned back to his house followed by Hare Ram Singh who was joined by his men. Pankaj Singh was caught hold by them, taken to the door of Hare Ram Singh where Ranjit Singh and Anjani Singh began to assault him with wooden particles while remaining were engaged in apprehending him. Subsequently thereof, Pankaj was taken to hospital where he was declared dead.

Patna High Court Cr.Misc. No.25015 of 2016 (3) dt.12-07-2016 2/2 Case diary is available, wherefrom, it is evident that the I.O. had not found any kind of shot belonging to petitioner Hare Ram Singh. Furthermore, it is evident that informant as well as petitioner happens to be the full brother and are engaged in litigation since before over land dispute. Consequent thereupon, presence of deceased Pankaj Singh to the shop of petitioner Hareram Singh for purchase of wine appears to be improbable story.

Be that as it may, the petitioner is not an assailant and on account thereof, his case stood on similar footing than that of other co-accused who have already been granted bail vide Cr. Misc. no. 23315/2016 (Shankar Chaudhary & ors. vs. The State of Bihar).

Accordingly, petitioner namely Hare Ram Singh is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of like amount each to the satisfaction of S.D.J.M., Manjhaul (Begusarai) in connection with Khodawandpur P.S. case no. 23/2016.
