JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 25-04-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 302/201/34 of the Indian Penal Code.

The FIR was registered against unknown for the murder of son of the informant.

Learned counsel appearing for the petitioner submits that petitioner is not named in the FIR. The name of petitioner has transpired in this case during the course of investigation in the confessional statement of co-accused. It is submitted that save and except confessional statement there is no material against this petitioner to show his involvement in the aforesaid crime. Petitioner is in custody since 19.06.2021 and

Learned counsel appearing for the State opposes the prayer for bail and submits that on the disclosure made by this petitioner knife used in the crime was recovered from the house of this petitioner.

Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.
