Heard the parties in virtual Court.

Petitioner seeks bail in a case registered for the offences punishable under Sections 341,323,307,504/34 of IPC and Sections 25(1-b)a/26/35 and 27 of Arms Act. Submission is that the recovered firearm was not seized from physical possession or house of the petitioner rather the informant a private person alleges that the same fell down and he lifted it and produced before the police. Petitioner is in custody since 02.08.2020.

Though the petitioner has got criminal antecedent, however, in this case, no non-bailable offence is made out against the petitioner, let the petitioner, above named, be

Patna High Court CR. MISC. No.17031 of 2021(2) dt.30-07-2021 2/2 released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Andhramath Police Station Case No.75 of 2020 corresponding to G.R.No.1233 of 2020 with following conditions:

(a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
