JUSTICE SANDEEP KUMAR ORAL ORDER 03-05-2023 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State. Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Malaypur P.S. Case No. 57 of 2021 registered for the offence under Sections 272, 273, 34 of the Indian Penal Code and Sections 30(a), 36, 41(i) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

Learned counsel for the petitioner submits that the petitioner is in custody since 16.12.2022 and there is no recovery from his possession. The petitioner has four antecedent.

Learned APP has vehemently opposed the prayer of

Patna High Court CR. MISC. No.7263 of 2023(2) dt.03-05-2023 2/2 bail.

Considering the period of custody and no recovery of liquor from his possession, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail after framing of charge, if the charge has not been framed as yet and on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Exclusive Excise-1, Jamui in connection with Malaypur P.S. Case No. 57 of 2021.

The petitioner will visit Malaypur Police Station on the first Sunday of each month. Any default in appearance at the Police Station would be result in cancellation of bail bond of the petitioner.
