Earlier the prayer for anticipatory bail of the petitioner was disposed of vide order dated 6.9.2018 passed in Cr. Misc. No.34516 of 2018 with direction to surrender within a period of six weeks in the court below and on the same day O.P.no.2 shall appear in the court and if the court is found that O.P.no.2 is residing with the petitioner, the court below shall release the petitioner on bail to its own satisfaction, however, it appears that petitioner has not surrendered within six weeks and the present application for modification has been filed.

Submission of the learned counsel for the petitioner is that he will surrender if some reasonable time is allowed.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to interfere with the earlier order, however, the petitoner is directed to surrender within a period of four weeks from the date of receipt of the order and pay for regular bail, which shall be considered by the learned court below on its own merit without being prejudiced by the order of this Court.

With the aforesaid observation, this application is disposed of.
