JUSTICE SUDHIR SINGH ORAL ORDER 17-12-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 302/34 of the Indian Penal Code.
Allegation is that grand-father and grand-mother of the informant was killed and petitioner's name has come on the basis of confessional statement of the co-accused.
A report regarding stage of the case was called for from the trial court vide order dated 21.8.2015, same is at flag 'G'. From perusal of the said report it appears that out of eight witnesses, four witnesses have already been examined and remaining four official witnesses are yet to be examined. Considering the aforesaid facts and circumstances that the trial is already in progress, I am not inclined to grant bail to the petitioner at this stage, same is rejected.
Any how, the court below is directed to take all necessary steps to get the remaining official witnesses examined preferably within a period of six months from the date of receipt/production

The District Magistrate, Patna, is directed to take all necessary steps to ensure that the said remaining official witnesses are produced on the date fixed by the court below in connection with S.T. no. 1326 of 2012 pending in the court of A.D.J.-II, Danapur, Patna, so that the trial may be concluded within the aforesaid stipulated period.
