JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
The informant is not an eye witness of the alleged occurrence though she claims that deceased disclosed the name of petitioner and several other F.I.R. named accused just after the alleged occurrence. Moreover, having more or less similar allegation, one co-accused, Rausan Kumar Singh @ Rausan Singh has already been granted privilege of bail by a co-ordinate Bench of this Court vide order dated 13.10.2015 passed in Cr. Misc. No. 39480 of 2015. Petitioner does not have any criminal antecedent
Patna High Court Cr.Misc. No.23781 of 2016 (3) dt.13-07-2016 2/2 and no specific overt-act has been attributed against him. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Bakhtiyarpur (Balwahat O.P.) P.S. Case No. 169 of 2015.
