The petitioner is languishing in custody for the offences punishable under Sections 302, 324/34 of the Indian Penal Code.

For land dispute three persons including the petitioner allegedly assaulted with lathi to the husband of the informant as a result whereof he died.

Submission of the learned counsel for petitioner is that the doctor has found single head injury, which was cause of death. It is difficult to attribute as to who of the three persons caused single head injury. Petitioner is in custody since 07.08.2018 and he has got no criminal antecedent. Investigation of the case is complete and petitioner is ready to co-operate with

Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Khaira P.S. Case No. 303 of 2018, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Banti/Rajan U T
