The petitioner seeks bail in a case under Section 376 and other sections of the Indian Penal Code.

The prosecutrix alleged that near the beetle shop of her husband godown of the petitioner is situated. The petitioner disclosed the prosecutrix that he loved her and on the pretext of marriage established physical relationship with her. She also became pregnant but later on she was aborted. The petitioner solemnized marriage with another girl. On the face of it, it appears that the victim, who is a married woman, has sexual relation with the petitioner out of her own free will.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner

Patna High Court Cr.Misc. No.34961 of 2015 (2) dt.21-08-2015 2/2 is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Kishanganj in Kishanganj (Mahila) P.S. Case No. 34 of 2015 (G. R. No. 1026 of 2015).
