Petitioner has prayed for directing the respondents to release his Pulsar motor cycle bearing Registration No. JH 15 S 5003, Chasis No. MD2A11CY4JRK06177 which was seized in connection with Excise Case No. 113 of 2018 dated 22.7.2018 registered for the offence punishable under sections 30(a) and 56(d) of the Bihar Prohibition and Excise Act. It is submitted by learned counsel for the petitioner that confiscation proceeding has already been initiated. In that view of the matter, writ petition is disposed of with liberty to the petitioner to move before the competent authority for release of his vehicle.

Needless to state that if such application is moved, the
