====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 04-02-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Turkauliya P.S. Case No. 536 of 2018, instituted for the offence under Section(s) 461 and 379 of the Indian Penal Code 1860. Subsequently, Section 411 Indian Penal Code was added.

Counsel for the petitioner submits that petitioner is not named in the written report. Petitioner has been arrested by the police merely on suspicion. He has been implicated in the case only on the ground that two Mobile phones have been recovered from his possession. No Test Identification Parade of those Mobile Phones have been held.

Petitioner is in custody since 3.10.2018 having clean

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Turkauliya P.S. Case No. 536 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
