JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 12-03-2024 Heard learned counsel for the petitioner and the State.

2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 384,307,379/34 and other allied sections of the Indian Penal Code.

3. As per the prosecution case, all the FIR named accused persons including this petitioner entered the house of the informant and assaulted the informant and his family members by means of lathi, danda, iron rod. Petitioner snatched ornaments from the mother and uncle of the informant. Petitioner and co-accused Rana and Basant were armed with pistol and they threatened the informant side to shoot them.

4. Learned counsel appearing for the petitioner submits that the parties are agnate and there is land dipsute between them for which matter is pending before the Revenue officials as well as before the Court of ADM, Saharsa. In this

Patna High Court CR. MISC. No.12759 of 2024(2) dt.12-03-2024 2/2 regard, a complainant against erring revenue officials, is also pending before the court of the Chief Judicial Magistrate, Saharsa. Doctor has found simple injury. Allegation is general and omnibus. Rest of the allegations are ornamental in nature. Petitioner claims clean antecedent.

5. Learned counsel for the State as well as the informant oppose the prayer for bail.

5. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Saharsa in Bihra Police Station Case No. 181 of 2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
