JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-03-2019 Petitioners seek bail in anticipation of their arrest in connection with Bisfi (Patauna) P.S. Case No. 129 of 2018, registered for the offences punishable under Sections 147, 307 379 and other sections of the Indian Penal Code and Section 3 of Damage to Public Property Act.
Allegation against the petitioners and other accused persons is of creating obstruction to the police party in discharging their duties and there is also allegation of assault to the police party against them.
Submission of learned counsel for the petitioners is that FIR has been lodged against several persons, including the petitioner and several unknown persons also and no specific
Patna High Court CR. MISC. No.5455 of 2019(3) dt.13-03-2019 2/2 allegation against any of the petitioners.

Having heard both sides and in the facts and circumstances, let petitioners, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Benipatti at Madhubani, in connection with Bisfi (Patauna) P.S. Case No. 129 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioners shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
