1. Heard learned counsel for the petitioner and the learned APP for the State.
2. Petitioner seeks regular bail in connection with Ghoghardiha P.S. Case No. 09 of 2023 dated 17.01.2023 registered for the offence punishable under Section 392 of the Indian Penal Code.
3. The main submissions advanced by the learned counsel for the petitioner are that the petitioner is not named in the FIR and during investigation, one co-accused namely Shailendra Yadav was apprehended who disclosed the name of this petitioner and other co-accused but except the statement of the said co-accused, there is no material to show his involvement in the alleged crime, though against him there are criminal antecedent of four cases, in which, he is on bail and
Patna High Court CR. MISC. No.7638 of 2024(2) dt.19-02-2024 2/2 against him the investigation has been completed. Further submission is that one co-accused namely Pankaj Kumar @ Pankaj Yadav carrying similar nature of allegation has been granted bail by a co-ordinate Bench of this Court vide order dated 01.09.2023 passed in Cr. Misc. No. 58481/2023.
4. Learned APP appearing for the State has opposed the bail prayer.
5. Considering the above submissions, this Court is inclined to accept the petitioner's bail prayer. Accordingly, let the petitioner named-above be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Ghoghardiha P.S.
