The petitioner seeks bail in Mahila P. S. Case No. 18 of 2018 instituted for the offence under Section(s) 341, 323, 504, 406, 498A, 313/34 of the Indian Penal Code. Learned counsel for petitioner submits that petitioner is husband of informant. The informant does not want to stay with the petitioner along with family members. She was putting pressure on the petitioner to demand family partition and when the petitioner was not ready for the same, she left his association out of her own sweet will and volition and started living at her parents house. He further submits that there is no any injury to substantiate the allegation of miscarriage on account of assault as alleged in the FIR.

The petitioner is in custody since 1.12.2018 having no criminal antecedent.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the 10th ACJM, East Champaran at Motihari, in connection with Mahila P. S. Case No. 18 of 2018 subject to the condition that both the bailors shall be the close relative of the petitioner.
