====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 27-02-2025 Heard learned counsel for the petitioners and learned APP for the State.
2. Learned counsel for the petitioners is permitted to make necessary correction in cause title of the bail petition in the during course of the day.
3. The petitioners have preferred this application for grant of regular bail in connection with Jaynagar P.S Case No. 366 of 2024, dated 20.12.2024, registered for the offence punishable under Sections 274, 275, 317(5), 3(5) of the B.N.S. and 30(a) of the Bihar Prohibition and Excise Act.
4. As per the prosecution case, total 466.560 litres of Nepali country-made and Nepali foreign liquor was recovered from the three motorcycle.
5. Learned counsel for the petitioners has submitted that
Patna High Court CR. MISC. No.4991 of 2025(2) dt.27-02-2025 2/2 the petitioners are innocent and have falsely been implicated in this case. The petitioners are not the owner of the said three seized motorcycles. The petitioners are working as labours and they maintain their livelihood. The petitioners are returning after finishing their work, the police arrested the petitioners merely on the basis of suspicion. Nothing has been recovered from the possession of the petitioners. The petitioners have clean antecedent as stated in para 3 of the bail petition. The petitioners are in custody since 21.12.2024.
6. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioners.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioners abovenamed, are directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court concerned, Madhubani, in connection with Jaynagar P.S. Case No. 366 of 2024.
8. The application stands allowed.
