The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 419, 420, 356 and 379 of the Indian Penal Code.

It is a case duping the amount of Rs.27,000/- from the informant by the accused persons along with this petitioner and the name of the petitioner stated by co-accused who was apprehended by the public at the time of occurrence. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. Petitioner has got clean antecedent.

Learned APP appearing for the State has opposed the prayer for anticipatory bail and submitted that the name of the

Patna High Court CR. MISC. No.6638 of 2022(2) dt.16-06-2022 2/2 petitioner stated by the co-accused Yamuna Prasad before the public which is admissible in the eye of law and petitioner has specific overt-act in this occurrence and several witnesses have supported the prosecution case.

After considering the aforesaid facts, I am not inclined to grant anticipatory bail the petitioner. Prayer for anticipatory of the petitioner is rejected. However, the petitioner is directed to surrender before the court below and make prayer for regular bail without being prejudiced by this order.
