1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Kalyanpur Police Station Case No.336 of 2024, disclosing offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
3. As per the prosecution case, on 10.10.2024, while on patrol, the informant received a secret information about two individuals transporting liquor on a motorcycle. Upon such information, the police set up an interception near Vrindavan Chowk at around 03:50 AM on 11.10.2024. On seeing the police party, both the persons attempted to flee, but one was caught along with the motorcycle, while the other escaped due to darkness. The apprehended co-accused, Ranjan
Patna High Court CR. MISC. No.6810 of 2025(2) dt.20-03-2025 2/3 Kumar, identified the absconding individual as the petitioner. A search of the motorcycle led to the recovery of 102 liters of country-made liquor.

Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in the present case due to the confessional statement made by the apprehended coaccused and the petitioner was neither present at the place of occurrence nor has any connection with the seized illicit liquor or the motorcycle.

Having regard to the submissions made on behalf of the parties and taking into consideration the fact that the name of the petitioner transpired on the basis of a confessional statement made by the co-accused and the petitioner is neither the rider or the owner of the motorcycle nor anything was recovered from the conscious possession of the petitioner, I am inclined to grant the petitioner privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount

No.6810 of 2025(2) dt.20-03-2025 3/3 each to the satisfaction of learned Exclusive Special Excise Court No.3, Civil Court, East Champaran at Motihari, in connection with Kalyanpur Police Station Case No.336 of 2024, subject to the condition laid down under Section 482(2) of the BNSS, 2023.
