JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-02-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Kutumba P. S. Case No. 184 of 2019 registered for the offences punishable under Sections 341, 323, 354, 504, 506 of the Indian Penal Code.
Petitioner is said to have abused and assaulted the informant in inebriated condition. However, it is submitted on behalf of the petitioner that petitioner is agnate of the informant, who happens to be member of District Board and, as a matter of fact, the husband of the informant is a veteran criminal and informant as well as her husband want to grab the land of the petitioner and, that is why, the informant has brought
Patna High Court CR. MISC. No.4968 of 2020(2) dt.29-02-2020 2/2 this false case. It is further submitted that moreover, petitioner does not have any criminal antecedent, which is evident from perusal of para 3 of the petition.
Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that the petitioner, above named, in the event of his arrest/surrender within six weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Kutumba P.
