03-03-2020 Heard learned counsel for the parties.

The petitioner apprehends her arrest in Ghanshyampur P.S. Case No. 66 of 2019 (G.R. No. 229 of 2019) registered for the offence under Sections 498A/302/34 of the Indian Penal Code.

As per prosecution case, the informant's daughter was married with petitioner's son Bigyanand Roy in the year 2005 and after the marriage, the informant's daughter was harassed for the demand of dowry and petitioner with her family members burnt the informant's daughter by pouring kerosene oil and during course of treatment, she died due to burn injury. It is submitted on behalf of petitioner that petitioner is mother-in-law of the deceased and she is living separately. It is further submitted that while the deceased was preparing tea,

No.4330 of 2020(2) dt.03-03-2020 2/2 she caught fire and immediately thereafter, she was taken to Primary Health Centre, from where, she was referred to D.M.C.H. and ultimately considering her critical situation, she was taken to P.M.C.H. by her in-laws members, where she died. It is further submitted that two other co-accused have already been granted anticipatory bail by this Court, vide order dated 16-11-2019 passed in Cr.Misc. No. 58428 of 2019 (Annexure -3). Husband of the deceased is already in custody and petitioner, who is lady, is aged about 70 years old. Considering the aforesaid facts and circumstances as well as nature of accusation, in the event of her arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs.

10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Biraul, District - Darbhanga in connection with Ghanshyampur P.S. Case No. 66 of 2019 (G.R. No. 229 of 2019), subject to condition, as laid down under Section 438(2) of the Cr.P.C.
