JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-02-2019 This is an application for grant of anticipatory bail in connection with Agiaon (G) P.S. Case No. 98 of 2018, disclosing offences under Sections 304(B), 34 of the Indian Penal Code.

Allegation against the petitioners, who happen to be devar, cousin mother-in-law and fufa, respectively of the deceased, is of demand of rupees three lacs and one Apache motorcycle.

Submission of learned counsel for the petitioners is that postmortem report does not show any injury on the person of the deceased and furthermore they are living separately. Further submission is that the allegation is general and omnibus

Heard learned A.P.P. as well as learned counsel for the informant, they have opposed the prayer for anticipatory bail of the petitioners stating that there is also allegation of demand of dowry against petitioner nos.2 & 3.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VII, Bhojpur, Ara, in connection with Agiaon (G) P.S. Case No. 98 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
