The petitioner seeks bail in Chapra Rail P.S. Case No. 11 of 2013 registered under sections 307 and other allied sections of the Indian Penal Code.
The informant lodged the case against Nurul and Rafiq and alleged that they have mixed intoxicant in food and looted away his bag containing different articles. Learned counsel for the petitioner submits that petitioner is not named in the first information report and nothing has been recovered from his possession. Name of the petitioner was disclosed by co-accused and on the basis of such disclosure petitioner was arrested and his confessional statement was also recorded.

No.34629 of 2014 (3) dt.16-01-2015 Having considered the fact that the name of the petitioner has figured in course of confessional statement and no tangible evidence has come against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Railway Judicial Magistrate, Sonepur, Dist.
