Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Silao P.S. Case No. 104 of 2019 as S.T. No. 216/2020 registered for the offence punishable under Sections 302 and 120(B)/34 of the Indian Penal Code.

The petitioner is in custody since 05.06.2019. He does not have any criminal antecedent. He had earlier approached this Court for grant of regular bail, which was rejected by an order dated 06.03.2020 passed in Cr. Misc. No. 78301 of 2019 with an observation that he shall be at liberty to

Patna High Court CR. MISC. No.16523 of 2021(2) dt.28-07-2021 2/2 renew his prayer for bail after framing of charge. Accordingly present application has been filed renewing his prayer for bail, as charge has been framed.

From the F.I.R., it is evident that the occurrence had taken place in the wake of dispute relating to joint family property.

Considering the circumstance that the petitioner has remained in custody for more than two years and there is no likelihood of expeditious conclusion of trial, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 3rd, Nalanda at Bihar Sharif in Silao P.S. Case No. 104 of 2019.
