Therefore, both the aforesaid applications have been heard together and are being disposed of
Patna High Court Cr.Misc. No.25122 of 2016 (4) dt.03-08-2016 2/2 by this common order.
Learned counsel for the petitioners submits that petitioners are not named in the F.I.R. In course of investigation the name of the petitioners surfaced in the confessional statement of co-accused Sanjay Kumar. Further submission is that Chargesheet has already been submitted. Further submission is that similarly situated co-accused, Jay Prakash Giri has already been granted privilege of bail by a co-ordinate Bench of this Court vide order dated 19.07.2016 passed in Criminal Misc. No. 25683 of 2016. The petitioners are in custody since 29.01.2016 and 27.01.2016.
Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bettiah, West Champaran in connection with Majhauliya P.S. Case No. 15 of 2016. Out of two sureties, one surety must be the close relative of the petitioners, who will file an affidavit showing his relation with the petitioners.
