The petitioner is apprehending his arrest in connection with Barahara P.S.Case no.290 of 2018 registered for offences punishable under Sections 461 and 379 of the Indian Penal Code.
Allegation against the petitioner as per FIR is of theft of 11 computers , batteries and hand lump of the school. It appears that the articles have been recovered from the shop of the petitioner.
Submission of the learned counsel for the petitioner is that he has no knowledge that those articles were stolen article and in good faith he had kept them.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and
Patna High Court CR. MISC. No.7881 of 2019(4) dt.06-05-2019 2/2 circumstances, as stated above, let the petitioner surrender before the learned court below within a period of six weeks from the date of receipt of the order and make prayer for regular bail, which will be considered by the learned court below without on its own merit being prejudiced by the order of this Court and if possible to be disposed of on the same day. With the aforesaid direction, this application is disposed of.
