JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 21.04.2014 in a case initially registered for the offence punishable under Section 364 of the Indian Penal Code but later on, after recovery of dead body of the victim Sections 302, 201 and 120B of the Indian Penal Code were also added.

Admittedly, none has seen the actual killing of the deceased and the petitioner has been dragged in this case on the ground that deceased and one Ravipal had illicit relation with daughter of the petitioner which caused annoyance to the petitioner and thereafter petitioner having hatched up a conspiracy committed the murder of the deceased. It appears that except

Patna High Court Cr.Misc. No.34024 of 2014 (3) dt.22-01-2015 suspicion and after one month of recovery of dead body the claim of one witness to have seen the petitioner near the place of occurrence, there is nothing against the petitioner. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st Class, Banka in connection with Belhar P.S. Case No. 52 of 2014.
