JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 31-08-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. From perusal of the impugned order, it appears that the learned 5th Additional District Judge, Gopalganj has not dismissed the application on merit, rather the same was dismissed due to non prosecution and, accordingly, petitioner is permitted to withdraw this petition and to file fresh petition for bail before the Session Judge, Gopalganj which shall be heard and considered by the learned Sessions Judge, Gopalganj on its own merit without being prejudiced by the order of this Court.
