Petitioner seeks bail in Bhairav Asthan P.S. Case No.87 of 2018 instituted for the offence under Section(s) 394, 307, 328, 397 Indian Penal Code.

In the written report, it is alleged that this petitioner along with other persons, as named in the First Information Report, has hired the vehicle of the informant for Rs.1800/-. In the way, the petitioner gave some intoxicant to the informant and attempted to snatch his vehicle.

Counsel for the petitioner submits that besides general and omnibus allegation there is no specific overt act alleged against the petitioner.

Petitioner is in custody since 12.08.2018.

No.6731 of 2019(2) dt.06-02-2019 2/2 Counsel for the petitioner further submits that coaccused with similar allegation have already been granted regular bail by co-ordinate Bench of this Court by order dated 08.10.2018 passed in Cr. Misc. No.62120 of 2018. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, 1st, Jhanjharpur, Madhubani, in connection with Bhairav Asthan P.S. Case No.87 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
