JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-04-2023 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Desari P.S. Case No. 499 of 2022 registered for the offences punishable under Sections 414 of the Indian Penal Code and section 30(a) of Bihar Prohibition & Excise Amendment Act. As per the prosecution case, 15.750 liters Indian made foreign liquor was recovered from Scooty. Learned counsel for the petitioners submits that petitioner has falsely been implicated in this case. No incriminating material has been recovered from conscious possession of the petitioner and petitioner has no concern with the seized Scooty. Petitioner has clean antecedent.
