JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-08-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. It would appear from perusal of the first information report that petitioner was wanted in Paraiya P.S. Case No. 112 of 2014 and when police party went to arrest the petitioner and other accused of the above stated case, petitioner and his associates made firing causing firearm injury to one constable. No doubt, petitioner is named but admittedly, neither he was caught on the spot nor anything was recovered from his conscious possession and moreover, it is not specific as to who caused firearm injury to injured constable.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on

Patna High Court Cr.Misc. No.33918 of 2015 (2) dt.28-08-2015 2/2 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Kumar Avinash, Judicial Magistrate 1st Class, Gaya in connection with Paraiya P.S. Case No. 120 of 2014.
