JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-01-2020 Petitioners seek bail in connection with Ghosi (Okari) P.S. Case No.406 of 2019 registered for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 337, 338, 354, 307 and 302 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the Petitioners and several other accused persons is of assaulting the deceased causing his death.

Submission of learned counsel for the petitioners is that there is case and counter case between the parties. No

Patna High Court CR. MISC. No.4765 of 2020(2) dt.29-01-2020 2/2 specific allegation has been attributed against the petitioners. From perusal of the postmortem report, it appears that only one injury has been found by the doctor on the person of injured. They are in custody since 16.11.2019 having no criminal antecedent.

In view of above facts and circumstances, let petitioners be released on bail on furnishing bail bonds of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Jehanabad in connection with Ghosi (Okari) P.S. Case No.406 of 2019, subject to the condition that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the court concerned and further condition that they have to co-operate in disposal of the case, otherwise their bail bonds shall be cancelled.
